This is a basic guide for residential landlords who want to increase rent or perform an eviction. This guide will help residential landlords determine if Local Ordinances or the California Tenant Protection Act (specifically Civil Code 1947.12 and 1946.2) apply to their situation and if so, what notices need to be provided to the tenant.

This guide specifically addresses the California Tenant Protection Act and how it may impact a landlord's ability to raise rent or evict a tenant.
AS A LANDLORD, PLEASE READ THE EXEMPTIONS TAB CAREFULLY TO SEE IF THE TENANT PROTECTION ACT APPLIES TO YOUR TYPE OF PROPERTY AND TENANTS, AND THE REQUIRED NOTICE PROVISIONS.
The California Tenant Protection Act consists of two main components:
1.) Civil Code §§ 1947.12 - 1947.13 regulates the amount that rent can be increased annually for specific dwellings in specific situations.
2.) Civil Code § 1946.2 sets forth the circumstances under which a residential tenant in a covered unit may be evicted and what notices are required.
See individual tabs in this guide for more information on exemptions, rent increases, evictions, required notices, and resources.
