Service can be done by mail or by personally delivering a copy of your motion to the prosecutor’s office; but, you cannot serve the documents yourself. Your motion must be served by someone over 18 years old who is not a party to the case. This means that you need a friend, family member, neighbor, or co-worker to serve the motion for you.
You will want to file your motion in the same Courthouse where your case was initially heard. This Guide focuses on motions to be brought in San Diego County Superior Court.
