If your property was used as an exhibit at trial, you can make a motion under Penal Code §1417.5 to have the property returned after your trial is over.
60 days after the conclusion of a criminal case, the court clerk should notify you that exhibits seized from you and introduced at trial are available for release. You then have 15 days to make a motion for the return of the property under Penal Code §1417.5, if you were in lawful possession of the property at the time it was seized, or if you can establish ownership of the property or a right to possess it.
An appeal of motion for retrial by either side may delay the release date.
Use these sample templates to draft your own motion. Read each brief carefully and tailor it to your own situation.
